1. Privacy policy

This privacy policy explains the nature, scope and purpose of the collection and use of personal data by IPM Institut für persönlichkeitsorientiertes Management AG (hereinafter referred to as "we" or "us") and provides information about the rights to which you are entitled. These rights are governed by the applicable data protection laws.

3. Storage of personal data and its use

IPM AG only stores and processes your personal data if you voluntarily provide it to us for a specific purpose (e.g. as part of an enquiry) or if this is necessary for technical reasons or to ensure a smooth connection or convenient use of this website. Your personal data will be processed confidentially and exclusively for the purposes stated below. Processing is carried out in accordance with the Federal Act on Data Protection (FADP) and/or the EU General Data Protection Regulation (GDPR), as applicable. References to provisions of the GDPR in this document are also deemed to be references to the corresponding provisions of the DPA.

We only store your data in Switzerland or in the EU.

3.1 Log files

Our website is hosted by Nine Internet Solutions AG (Badenerstrasse 47, 8004 Zurich, CH).

In order to optimise and maintain our website, we log any technical errors that may occur when you visit our website. Furthermore, when you use this website, information is automatically collected that your device's browser transmits to our host provider. These are

  • IP address and operating system of your end device,
  • Browser type, version, language
  • Date and time of the server request,
  • called file,
  • the website from which the access was made (referrer URL),
  • the status code (e.g. 404) and
  • the transmission protocol used (e.g. HTTP/2).

This data is collected and stored by our host provider in order to optimise processes and procedures, in particular in connection with the use of our website and the security and stability of the computer system.

We collect and use your personal data in log files to enable needs-based communication with you via our website and in this respect have a legitimate interest in data processing within the meaning of Art. 6 para. 1 sentence 1 lit. f GDPR.

3.2 Personal data for registration:

When you register with us, the following personal data is entered by you via the input mask and stored by us:

  • IP address
  • Email address
  • First name
  • Surname
  • Date of birth
  • Address (optional)
  • Gender
  • Telephone number (optional)

3.3 Personal data for profile creation

If you decide to order a personality profile offered on our website, we will collect and store the personal data required to create the profile. The data requested about you is based on the personality profile you have ordered and is entered by you in the online profile creation via input masks and stored by us under your user ID.
The provision of personal data for profiling is voluntary. However, the profiling and/or counselling you have ordered is not possible without this information. You should therefore decide before placing an order whether you want us to collect and store your personal data required for profiling.

4 Processing and use of personal data

4.1 Personal data for registration

The personal data collected during your registration will be used exclusively to create and manage your user account and the associated user relationship.

4.2 Personal data for profile creation

Personal data that we collect and store as part of the creation of your profile will be used exclusively for the creation of your profile and stored under your user account.
Your profile data can only be used to create a team profile or management profile, for example, if you have expressly agreed to this in advance. Only your team leader/supervisor can order the creation of the team profile. Without your express prior consent, your personal data cannot be used to create other group profiles.

The IPM profiles created are also used in anonymised form to continuously improve the IPM system. The profiles used in this context cannot be linked to a specific or identifiable person and therefore no longer constitute personal data subject to data protection (see section 5.3).

If you receive an access code from a third party (e.g. from a coach in the context of a seminar or from your (potential) employer) for the creation of a profile, by using this code you express that the data you have entered and the profile created on this basis can also be viewed by this third party. Accordingly, your use of such a code constitutes your express consent to the disclosure of your data to this third party.

4.3 Other personal data (log files)

Other personal data is used exclusively for the use and processing of the user relationship, although this data is only stored and processed in anonymised form and therefore cannot be linked to you personally.

5. Deletion/anonymisation of the data

5.1 IPM single user

IPM individual users who do not have an IPM account can request the direct deletion of their personal data for profile creation and the profiles created by sending an email to support@ipmag.ch.

In any case, we will delete the personal data for profile creation and the profiles created if you have not logged into your profile for one year.

5.2 IPM multiple users

IPM multiple users who have access to their IPM account can request direct deletion of the account, their personal data for profile creation and the profiles created by sending an email to support@ipmag.ch.

They can also delete their profiles themselves directly via their account.

In any case, we will delete the personal data for profile creation and the profiles created one year after termination of the license agreement.

The deletion of the user account also leads to the deletion of the data stored in relation to this account, insofar as this is not required for the assertion of claims, in particular for invoicing.

5.3 Anonymised profiles

The deletion of the profiles mentioned in sections 5.1 and 5.2 is carried out in such a way that the assignment of the profiles to the creator and other persons involved (e.g. team) is irretrievably deleted. The profiles anonymised in this way no longer contain any data that would allow anyone to assign them to a specific or identifiable natural person and therefore no longer constitute personal data subject to data protection; they are used by us for an unlimited period of time for the further development of the IPM system.

6. Disclosure to third parties:

We process and use your personal data only for the purposes described here. We will only pass on your personal data to third parties in the following exceptional cases:

  • You have expressly consented to the transmission beforehand;
  • to protect the vital interests of natural persons;
  • for the assertion, exercise or defence of legal claims, provided there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data
  • insofar as a legal obligation exists, Art. 6 para. 1 sentence 1 lit. c GDPR
  • insofar as the transfer is necessary for the processing of the contractual relationship with you in accordance with Art. 6 para. 1 sentence 1 lit. b GDPR.

Whenever we disclose your personal data to third parties to the extent described above, we ensure that it is used in accordance with the relevant data protection laws and this Privacy Policy

7. Cookies

We use cookies on our website insofar as this is technically necessary for the operation of our website. Cookies are small files that are automatically created by your browser and stored on your device when you visit our website. Information is stored in the cookie that results in each case in connection with the specific end device used. However, this does not mean that we obtain direct knowledge of your identity. On the one hand, the use of cookies serves to make the use of our website more pleasant for you. For example, we use session cookies to recognise that you have already visited individual pages of our website. These are automatically deleted after you leave our site.

In addition, we also use temporary cookies to optimise user-friendliness, which are stored on your end device for a specified period of time. If you visit our site again to use our services, it is automatically recognised that you have already visited us and which entries and settings you have made so that you do not have to enter them again. On the other hand, we use cookies to statistically record the use of our website and to evaluate it for the purpose of optimising our offer for you. These cookies enable us to automatically recognise that you have already visited our website when you visit it again. These cookies are automatically deleted after a defined period of time.

The data processed by cookies are necessary for the purposes mentioned to protect our legitimate interests and those of third parties in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR. Most browsers accept cookies automatically. However, you can configure your browser so that no cookies are stored on your computer or a message always appears before a new cookie is created. However, completely deactivating cookies may mean that you cannot use all the functions of our website.

8. Data security

Your stored personal data is protected against misuse and unauthorised access in all systems by appropriate technical and organisational security measures. These security measures are revised in line with technological developments.

9. User rights

Based on the Federal Act on Data Protection of 25 September 2020 (FADP) and within the scope of the GDPR, you have the following rights

  • To the extent provided for by the data protection law applicable to you, you can request information free of charge about the data stored relating to you, its origin, storage period, recipient and the purpose of the data processing.
  • You also have the right to rectification under the statutory conditions,
  • Cancellation,
  • Restriction of or objection to processing
  • and, if the GDPR applies, to the disclosure of this data for transfer to another organisation.
  • You can revoke your consent at any time with effect for the future. All you need to do is send an informal email to support@ipmag.ch.
